Privacy Policy

1. INTRODUCTION

    This Privacy Policy describes how Glean LLC ("Glean,""Company," "we," "us," or "our") collects, uses, discloses, retains, and protects information relating to individuals who access or use Glean's website, including any webpages, subdomains, and online services that link to this Privacy Policy (collectively, the"Platform"), and any related features, content, communications tools, and services made available through the Platform (collectively, the "Services"). Maintaining the privacy of your information is of paramount importance to us as it helps foster confidence, goodwill and stronger relationships with you, our customers.     The Services provide an online platform that enables users to connect with one another to donate food or to offer food for sale outside the retail setting. Users offering food are referred to as "Donors." Users seeking to receive or purchase food are referred to as "Receivers." The Platform may include, without limitation, account registration, user profiles, listings, requests, messaging, notifications, and map-based discovery features

    When you access the Platform and any other linked pages, features, content, or applications offered in connection with our Services, you acknowledge and accept the practices and policies outlined in this Privacy Policy.
  • (d)
    This Privacy Policy is incorporated by reference into, and should be read together with, Glean’s Terms of Service. In the event of a conflict between this Privacy Policy and the Terms of Service regarding privacy or data processing, this Privacy Policy will control to the extent of the conflict
  • (e)
    For purposes of this Privacy Policy, "Personal Information" means information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular consumer or household, as that concept is defined under applicable California privacy law. "Sensitive Personal Information" has the meaning given under applicable California privacy law and generally includes certain sensitive categories of data such as precise geolocation, certain account credentials, and other categories defined by law. Information that is aggregated or deidentified is not Personal Information to the extent it is maintained and used in a manner that is not reasonably capable of being associated with an individual.

2. NOTICE AT COLLECTION AND SUMMARY OF PRACTICES

  • 2.1.
    Categories of Personal Information. Depending on how you use the Services, Glean may collect the following categories of Personal Information: identifiers (such as name, email address, and account login information); contact and profile information (such as phone number, profile photo, and other details you choose to provide); commercial information (such as transaction details relating to purchases or sales of food via the Platform, if applicable); geolocation information (such as location you provide for pickups and, if enabled, approximate location derived from device or browser signals, and in certain cases precise geolocation if you choose to share it); internet or other electronic network activity information (such as interactions with the Platform, log data, cookie identifiers, and analytics data); communications content (such as messages and communications exchanged through the Platform or sent to Glean); user-generated content (such as listings, descriptions, photographs, comments, and other content you post); and inferences drawn from the foregoing information to personalize or improve the Services (such as suggesting listings or improving search and safety features).
  • 2.2.
    Sources of Personal Information. Glean collects Personal Information from (i) you directly, when you create an account, complete a profile, post or respond to listings, communicate through the Platform, complete a transaction, or contact Glean; (ii) automatically when you access or use the Platform, through cookies and similar technologies, log files, and analytics tools; (iii) other users, when they interact with you through the Platform (for example, communications and transaction coordination between Donors and Receivers); and (iv) service providers and third parties in connection with operating the Services (for example, payment processors, email delivery providers, hosting providers, and analytics providers), subject to your settings and applicable law.
  • 2.3.
    Purposes of collection and use. Glean collects and uses Personal Information to provide, operate, maintain, and improve the Services; to enable communications, coordination, and transactions between users; to authenticate users, maintain account security, prevent fraud, and protect the safety and integrity of the Platform; to provide customer support and respond to inquiries; to process payments where applicable through third-party payment processors; to personalize content and improve user experience; to conduct analytics, debugging, and quality assurance; to send service-related notices, administrative messages, and, where permitted, marketing communications; and to comply with applicable legal obligations, enforce our Terms of Service, and protect Glean’s rights and the rights of others.
  • 2.4.
    Disclosures of Personal Information. Glean may disclose Personal Information to (i) other users as necessary to facilitate interactions, communications, and transactions through the Platform (for example, sharing profile details and pickup logistics with counterparties); (ii) service providers and contractors that perform services on Glean’s behalf (such as hosting, customer support, payment processing, email delivery, analytics, security, and fraud prevention), subject to contractual protections where required by law; (iii) professional advisors (such as lawyers, accountants, and auditors) as needed for business purposes; (iv) governmental authorities, regulators, and law enforcement where required by law or to protect rights and safety; and (v) third parties in connection with a corporate transaction, such as a merger, acquisition, financing, reorganization, or sale of assets, subject to customary confidentiality protections and applicable law.
  • 2.5.
    Sale, sharing, and targeted advertising. Glean does not “sell” Personal Information, meaning it does not disclose Personal Information to third parties for monetary or other valuable consideration. If Glean uses third-party cookies, pixels, or similar technologies for cross-context behavioral advertising, those disclosures may constitute “sharing” of Personal Information as defined under applicable California privacy law. Instructions for opting out of sale/sharing (including, where applicable, through user-enabled opt-out preference signals such as Global Privacy Control) are described in Sections 9.6 and 9.7.

3. ELIGIBILITY AND CHILDREN’S PRIVACY

  • 3.1.
    3.1. Age restriction. The Services are intended for individuals who are at least eighteen (18) years of age. Glean does not knowingly collect Personal Information from children under thirteen (13). If Glean becomes aware that it has collected Personal Information from a child under thirteen (13) without appropriate authorization, Glean will take commercially reasonable steps to delete such information.

4. INFORMATION WE COLLECT IN DETAIL

  • 4.1.
    Information you provide. You may provide Personal Information when you register for an account, complete your profile, post or respond to listings, coordinate pickups, communicate with other users through the Platform, submit payment-related information to a payment processor, participate in surveys or promotions, or otherwise interact with the Services.
  • 4.2.
    Communications and content. Glean collects the content of communications you send through the Platform (such as messages to other users) and the content you post (such as listing descriptions and photos). Glean may also collect information you provide when you contact Glean for support.
  • 4.3.
    Automatically collected information. When you access or use the Platform, Glean may automatically collect information such as IP address; device and browser type; operating system; referring/exit pages; date/time stamps; clickstream data; pages viewed; actions taken within the Platform; and cookie identifiers and similar online identifiers.
  • 4.4.
    Cookies and similar technologies. Glean may use cookies, pixels, web beacons, local storage, and similar technologies to operate the Platform, remember preferences, understand usage, improve performance, and support analytics and advertising. You may be able to manage cookies through your browser settings and, where offered, through a cookie preference tool on the Platform. Certain cookies are necessary for the Platform to function properly, and disabling them may affect functionality.
  • 4.5.
    Analytics. Glean may use analytics services (such as Google Analytics or similar tools) to help understand how users interact with the Platform. Analytics providers may set cookies or similar technologies and collect information about your use of the Platform over time. Glean uses this information for analytics, troubleshooting, and improving the Services.
  • 4.6.
    Payment information. If the Services enable payments, payment card information and related billing details are typically collected and processed by third-party payment processors. Glean may receive limited payment-related information (for example, payment status, transaction identifiers, and the last four digits of a payment card) as necessary to provide the Services, prevent fraud, and provide support.
  • 4.7.
    Geolocation. The Services may involve location-based features, including displaying approximate location on a map and enabling pickups. Glean may collect location you provide (such as pickup address or neighborhood) and may collect approximate location derived from device or browser signals. If the Platform offers a feature that collects precise geolocation, Glean will request your permission where required by applicable law and will provide controls as required.

5. HOW WE USE INFORMATION

  • 5.1.
    Core service operations. Glean uses Personal Information to create and manage accounts; to enable Donor and Receiver interactions; to facilitate communications, coordination, and transactions; and to deliver the features and functionality of the Services.
  • 5.2.
    Safety, integrity, and compliance. Glean uses Personal Information to authenticate accounts; prevent, detect, investigate, and respond to suspected fraud, abuse, security incidents, and violations of our Terms of Service; protect the safety of users and the public; and comply with legal obligations and enforce legal rights.
  • 5.3.
    Communications. Glean uses Personal Information to send service-related notices (such as account, security, transactional, and administrative messages), respond to inquiries, and provide customer support.
  • 5.4.
    Improvements and analytics. Glean uses Personal Information (including usage data, analytics data, and feedback) to debug, maintain, and improve the Platform; develop new features; understand user preferences and trends; and perform internal research and analysis, including through aggregated or deidentified data where appropriate.
  • 5.5.
    Marketing. Where permitted by law and subject to your choices, Glean may use Personal Information to send marketing communications and promotional materials. You may opt out of marketing emails by using the unsubscribe mechanism provided in those messages. Even if you opt out of marketing communications, Glean may still send you non-promotional, service-related communications.

6. HOW WE DISCLOSE INFORMATION

  • 6.1.
    Disclosures to other users. The Services are designed to connect users. Accordingly, certain Personal Information may be disclosed to other users as necessary to facilitate interactions and transactions, such as profile information, listings, communications, and pickup logistics. You understand that information you choose to make public or share with others may be viewed, collected, and used by recipients and may be subject to their separate practices.
  • 6.2.
    Service providers and contractors. Glean discloses Personal Information to service providers and contractors that perform services on Glean’s behalf, including hosting, cloud storage, customer support, email delivery, analytics, security monitoring, fraud prevention, payment processing, and similar services. Where required by applicable law, Glean will maintain appropriate contractual restrictions with such parties regarding use and disclosure of Personal Information
  • 6.3.
    Legal and safety disclosures. Glean may disclose Personal Information if Glean reasonably believes disclosure is necessary:
    • (a)
      to comply with applicable law, regulation, legal process, or governmental request;
    • (b)
      to enforce our agreements and policies; to protect Glean's rights, property, or safety, or that of users or others; or,
    • (c)
      to detect, prevent, or address fraud, security, or technical issues.
  • 6.4.
    Corporate transactions. Glean may disclose or transfer Personal Information in connection with a corporate transaction, such as a merger, acquisition, financing, reorganization, bankruptcy, dissolution, or sale of some or all assets. In such circumstances, Personal Information may be transferred as a business asset subject to customary protections and applicable law.

7. DATA RETENTION AND SECURITY

  • 7.1.
    Retention. Glean retains Personal Information for as long as reasonably necessary to provide the Services; maintain accounts; facilitate transactions; comply with legal obligations; resolve disputes; enforce agreements; protect against fraud and abuse; and for other legitimate and lawful business purposes. Retention periods may vary depending on the type of information, the context in which it was collected, and applicable legal requirements. Where feasible, Glean discloses the length of time each category of Personal Information is retained; where that is not feasible, Glean retains Personal Information based on the criteria used to determine the applicable retention period for the relevant category, including: whether the information is needed to maintain an active account; facilitate or document transactions and safety-related interactions; comply with legal obligations; resolve disputes; enforce agreements; and prevent fraud and abuse.
  • 7.2.
    Security. Glean uses reasonable administrative, technical, and physical safeguards designed to protect Personal Information from unauthorized access, use, alteration, and disclosure. However, no method of transmission over the Internet or method of electronic storage is completely secure, and Glean cannot guarantee absolute security.
  • 7.3.
    Account responsibility. You are responsible for maintaining the confidentiality of your account credentials and for any activity under your account. If you suspect unauthorized access or misuse of your information, contact Glean promptly at gogleantoday@gmail.com.

8. YOUR PRIVACY CHOICES

  • 8.1.
    Account information. You may review and update certain account information by logging into your account (where applicable) and editing your profile settings.
  • 8.2.
    Email preferences. You may opt out of marketing emails by using the unsubscribe link in those emails. You may also contact Glean at gogleantoday@gmail.com to request assistance with certain communication preferences.
  • 8.3.
    Cookies and similar technologies. You can control certain cookies through your browser settings and, where offered, a cookie preference tool on the Platform. Blocking certain cookies may impact Platform functionality.

9. CALIFORNIA PRIVACY RIGHTS AND DISCLOSURES

  • 9.1.
    Applicability. This Section applies to individuals who are California residents to the extent the California Consumer Privacy Act, as amended (including by the California Privacy Rights Act), applies to Glean's processing of Personal Information. This Section is intended to supplement, and not replace, other disclosures in this Privacy Policy.
  • 9.2.
    Categories collected, disclosed, and purposes. Glean collects, uses, and discloses the categories of Personal Information described in Sections 2 and 4 for the purposes described in Sections 2 and 5 and may disclose such information to the categories of recipients described in Sections 2 and 6. Where required by applicable law, these disclosures describe Glean's practices during the preceding twelve (12) months, including whether Personal Information has been sold or shared (or if not, disclosing that fact) and whether Personal Information has been disclosed for a business purpose (or if not, disclosing that fact).
  • 9.3.
    Rights. Subject to applicable exceptions and verification requirements, eligible California residents may have the right to request (i) access to specific pieces of Personal Information Glean has collected about them, and information about Glean's collection, use, and disclosure practices; (ii) deletion of Personal Information; (iii) correction of inaccurate Personal Information; (iv) a portable copy of Personal Information in certain circumstances; (v) to opt out of the sale or sharing of Personal Information; and (vi) to limit the use and disclosure of Sensitive Personal Information to certain permitted purposes. California residents also have the right not to receive discriminatory treatment for exercising privacy rights.
  • 9.4.
    Submitting requests; verification. Requests may be submitted by emailing Glean at GoGleanToday@gmail.com and clearly stating the nature of the request (for example, “California Privacy Request Access,” “Delete,” “Correct,” “Opt Out,” or “Limit Sensitive Personal Information”). Glean will take reasonable steps to verify the requester's identity before processing certain requests, which may include confirming information associated with the requester's account or requesting additional information where permitted by law. If and to the extent applicable law requires Glean to offer additional designated methods for submitting requests (for example, a webform or toll-free telephone number), Glean will make those additional methods available through the Platform and will process requests received through those methods.
  • 9.5.
    Authorized agents. California residents may use an authorized agent to submit certain requests on their behalf where permitted by law. Glean may require proof that the agent is authorized to act on your behalf and may also require you to verify your identity directly with Glean.
  • 9.6.
    Opt-out of sale or sharing; Global Privacy Control. Where required by law, Glean will honor requests to opt out of the sale or sharing of Personal Information. Glean also honors eligible user-enabled opt-out preference signals (such as a Global Privacy Control signal) to the extent required by applicable law. If Glean receives such a signal, Glean will treat it as a request to opt out of sale/sharing for the browser or device (and, where applicable, account) from which the signal is received, consistent with applicable law.
  • 9.7.
    "Do Not Sell or Share" and "Limit the Use of My Sensitive Personal Information" mechanisms. Glean does not “sell” Personal Information, meaning Glean does not disclose Personal Information to third parties for monetary or other valuable consideration. If and to the extent Glean engages in activity that constitutes “sharing” of Personal Information for cross-context behavioral advertising, or if and to the extent Glean is required to provide a right to limit the use or disclosure of Sensitive Personal Information, Glean will provide the method(s) required by applicable California privacy law to exercise those rights. Depending on Glean's implementation and as permitted by law, those method(s) may include (i) a clear and conspicuous link titled “Do Not Sell or Share My Personal Information” (and, if applicable, “Limit the Use of My Sensitive Personal Information,” or a single combined link) made available through Glean's internet homepages or privacy settings, and/or (ii) honoring an eligible opt-out preference signal (such as Global Privacy Control) where required.
  • 9.8.
    Response timing. Glean will respond to verifiable consumer requests within the timeframes required by applicable law.
  • 9.9.
    California "Shine the Light" disclosure. California Civil Code Section 1798.83 permits California residents to request certain information regarding Glean’s disclosure of certain categories of Personal Information to third parties for their direct marketing purposes. 10. DO NOT TRACK AND ONLINE TRACKING DISCLOSURES

  • 10.1.
    Do Not Track. Some browsers transmit "Do Not Track" signals. Because there is no uniform industry standard for how to interpret such signals, Glean does not respond to Do Not Track signals as a general matter. However, where required by California law, Glean honors certain user-enabled opt-out preference signals (such as Global Privacy Control) as described in Section 9.6, to the extent such signals communicate an opt-out of the sale or sharing of Personal Information.

11. INTERNATIONAL USERS

  • 11.1.
    U.S. processing. Glean is based in the United States, and information collected through the Services may be processed and stored in the United States and other jurisdictions where Glean or its service providers operate. Data protection laws in the United States may differ from those in your place of residence. By using the Services, you understand that your information may be transferred to and processed in jurisdictions that may not provide the same level of protection as your home jurisdiction.

12. CHANGES TO THIS PRIVACY POLICY

  • 12.1.
    Updates. Glean may update this Privacy Policy from time to time. If Glean makes material changes, Glean will provide notice by posting the updated Privacy Policy on the Platform and may provide additional notice where required by law. Your continued use of the Services after the effective date of an updated Privacy Policy constitutes your acceptance of the updated Privacy Policy to the extent permitted by applicable law.
